Welcome to The House of Blackness (“THOB”). These Terms of Service govern your use of the THOB website, event platform, ticketing services and related services (collectively, the “Platform”).
By creating an account, purchasing a ticket, listing an event, or otherwise using the Platform, you agree to these Terms of Service.
1. About THOB
The House of Blackness is a platform connecting event organisers, artists, creatives and audiences. THOB provides tools for event discovery, ticket sales, event management and related services.
THOB may act as a platform or ticketing service provider for events organised by third parties. Unless expressly stated otherwise, the event organiser is responsible for the event itself.
2. Accounts
You may need to create an account to access certain features of the Platform.
You agree to:
Provide accurate and current information.
Keep your login credentials secure.
Not share your account with unauthorised persons.
Notify THOB if you believe your account has been compromised.
Accept responsibility for activity carried out through your account.
THOB reserves the right to suspend or terminate accounts that breach these Terms or are involved in fraudulent, abusive or unlawful activity.
3. Purchasing Tickets
When purchasing a ticket through THOB, you agree to provide accurate information, including a valid email address where required.
Once payment has been successfully processed, your ticket or booking confirmation will normally be sent to the email address provided during checkout.
You are responsible for checking your confirmation and ensuring that the event details are correct.
Tickets may be subject to additional terms imposed by the event organiser.
4. Tickets and Entry
A ticket provides the holder with the right to request admission to the relevant event, subject to the organiser's terms and venue capacity.
Event organisers and venues may require tickets to be presented electronically or in another accepted format.
Tickets may be scanned or electronically validated at the entrance.
A ticket may be refused or cancelled where:
The ticket has already been used.
The ticket has been duplicated, altered or obtained fraudulently.
The ticket is invalid or has been cancelled.
The holder fails to comply with the event organiser's or venue's reasonable entry requirements.
Unless expressly permitted by the organiser, tickets may not be reproduced, resold fraudulently or used for unauthorised commercial purposes.
5. Event Organisers
Organisers using THOB are responsible for ensuring that the information provided for their events is accurate and up to date.
Organisers are responsible for:
Event dates, times and locations.
Event descriptions and promotional material.
Ticket pricing and availability.
Event permits, licences and regulatory requirements.
Venue arrangements.
Health and safety requirements.
Providing the advertised event.
Managing attendees and admission.
Communicating material changes to ticket holders.
Refunds where applicable.
THOB does not guarantee that an event organiser will hold an event as advertised.
6. Event Changes and Cancellations
An event organiser may change or cancel an event.
Where THOB is informed of a material change or cancellation, THOB may communicate the relevant information to affected ticket holders.
Refund eligibility may depend on the circumstances of the cancellation, the organiser's refund policy and applicable consumer protection law.
Where THOB processes a refund on behalf of an organiser, the refund will normally be returned through the original payment method.
7. Refunds
Ticket purchases are subject to the refund and cancellation policy displayed at the time of purchase.
Unless otherwise stated, tickets are generally non-refundable where the purchaser simply changes their mind or is unable to attend.
Where an event is cancelled, materially changed or otherwise becomes subject to a refund under applicable law or the organiser's stated policy, eligible customers may receive a refund.
THOB may deduct or retain applicable processing or service fees where permitted by law and clearly disclosed at the time of purchase.
8. Payments
Payments may be processed by third-party payment providers such as Stripe.
THOB does not store complete payment card details on its own systems where payment processing is handled by the relevant payment provider.
You agree to provide accurate billing and payment information and confirm that you are authorised to use the payment method provided.
9. Event Organiser Fees
Organisers may be charged platform, ticketing, payment-processing or other applicable fees.
Any applicable fees will be communicated to the organiser before or during the relevant transaction or account setup.
THOB reserves the right to change its fees with reasonable notice.
10. Prohibited Use
You must not use the Platform to:
Commit fraud or facilitate fraudulent transactions.
Sell counterfeit or unauthorised tickets.
Upload unlawful or infringing material.
Misrepresent an event, organiser or ticket.
Attempt to gain unauthorised access to another account.
Interfere with the operation or security of the Platform.
Use automated systems to abuse, scrape or overload the Platform.
Use the Platform for unlawful purposes.
Circumvent ticketing, payment or security controls.
THOB may suspend or terminate access where it reasonably believes these Terms have been breached.
11. User Content
You may be able to upload or submit event descriptions, photographs, artwork, videos, logos and other content.
You retain ownership of your content.
By submitting content to THOB, you grant THOB a non-exclusive, worldwide licence to use, reproduce, display and distribute that content for the purposes of operating, promoting and providing the Platform and the relevant event.
You confirm that you have the necessary rights and permissions to submit the content.
12. Intellectual Property
The THOB name, branding, logos, website design, software, platform features and other THOB materials are owned by or licensed to THOB and may not be reproduced, modified or commercially exploited without permission.
Third-party trademarks and content remain the property of their respective owners.
13. Third-Party Services
The Platform may integrate with third-party services including payment providers, mapping services, email services, social media platforms and other technology providers.
Your use of those services may also be subject to the third party's own terms and policies.
14. Availability of the Platform
THOB aims to keep the Platform available and functioning reliably but does not guarantee uninterrupted or error-free operation.
The Platform may occasionally be unavailable because of maintenance, technical problems, security incidents or circumstances outside THOB's reasonable control.
15. Limitation of Liability
To the extent permitted by applicable law, THOB is not responsible for losses arising from:
An event organiser cancelling, changing or failing to provide an event.
A venue refusing admission in accordance with applicable event rules.
Incorrect information supplied by an organiser or customer.
Loss or misuse of a customer's account credentials.
Third-party services or payment providers.
Circumstances outside THOB's reasonable control.
Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited.
16. Privacy
Your use of the Platform is also subject to the THOB Privacy Policy, which explains how personal information is collected, used and protected.
17. Changes to These Terms
THOB may update these Terms from time to time.
The updated version will be published on the Platform with the revised date. Continued use of the Platform following an update constitutes acceptance of the updated Terms, to the extent permitted by applicable law.
18. Governing Law
These Terms shall be governed by the laws of the Republic of Ireland, subject to any mandatory consumer protection rights applicable to you.
Any disputes shall be handled by the courts having appropriate jurisdiction under applicable law.
